1. About these terms

These Terms of Use govern your access to and use of proximityplumbing.com.au and any related pages, forms, booking tools and content (the "Site"). By using the Site you agree to these terms, our Privacy Policy and our Cookie Policy. If you do not agree, please do not use the Site.

These terms cover the website only. The supply of plumbing services is governed by the quote you sign on the day, our Service Terms provided with that quote, our Lifetime Labour Warranty and the Australian Consumer Law.

2. Who we are

Proximity Plumbing is a family-owned plumbing, drainage, gas-fitting and hot-water business headquartered at 229 Bronte Road, Waverley, servicing Sydney's Eastern Suburbs, North Shore, Inner West and South Sydney. We hold NSW Contractor Licence 285594C and are fully insured for residential, strata and commercial work.

3. Information on the Site

We take care to keep the Site accurate and up to date, but information is provided for general guidance only. Plumbing advice on the Site is not a substitute for an on-site diagnosis by a licensed plumber. Prices, call-out fees, promotions and service areas shown on the Site are indicative and may change without notice; the price that applies to your job is the fixed price in the quote you approve before work begins.

Nothing on the Site constitutes legal, strata, insurance or financial advice. Where we describe common property versus lot-owner responsibility in strata buildings, that is a technical description only: responsibility under your by-laws is for the strata manager and committee to determine.

4. Online bookings and quote requests

Submitting a booking or quote request through the Site is a request for service, not a confirmed appointment. A booking is confirmed only when we contact you to agree a time. Emergency requests should always be made by phone.

When you submit a request you confirm that the details you provide are accurate, that you are the owner, occupier or an authorised agent of the property, and that you are over 18.

Service and diagnostic attendances may be subject to a call-out fee disclosed when you book. Fixed-price quotes are presented on site and must be approved and signed before work commences. We do not quote firm prices over the phone or on the Site for work we have not seen.

5. Acceptable use

You must not:

• use the Site for any unlawful purpose or in breach of any law;
• submit false, misleading or malicious bookings or enquiries;
• attempt to gain unauthorised access to the Site, its servers or any connected system;
• introduce viruses, scrapers, bots or other harmful code, or scrape content or data;
• interfere with the Site's operation or impose an unreasonable load on its infrastructure;
• impersonate Proximity, our staff or any other person;
• use our content, branding or reviews for your own commercial purposes without written permission.

We may suspend or block access to the Site for breach of these terms.

6. Intellectual property

All content on the Site (text, photographs, videos, logos, the Proximity Plumbing name and branding, awards imagery, review content, downloadable guides and the Site's design and code) is owned by or licensed to Proximity Plumbing and protected by Australian and international copyright and trade-mark law.

You may view, print or download pages for your personal, non-commercial use. You may not otherwise reproduce, modify, distribute, publish or commercially exploit any part of the Site without our prior written consent.

7. Reviews and testimonials

Reviews displayed on the Site are sourced from Google and other third-party platforms, or provided directly by customers with their consent. They reflect individual experiences and are not a guarantee of any particular outcome. We never write, purchase or incentivise reviews.

If you submit a testimonial, photo or comment to us, you grant Proximity a non-exclusive, royalty-free, perpetual licence to use it (with your first name and suburb only unless you agree otherwise) in our marketing, and you confirm it is your own, honest and does not infringe anyone's rights.

8. Third-party links and tools

The Site may contain links to third-party websites, booking widgets, payment gateways, maps and social-media platforms. We do not control and are not responsible for their content, availability or privacy practices. Links are provided for convenience and do not imply endorsement.

9. Availability

We aim to keep the Site available at all times but do not guarantee uninterrupted access. We may change, suspend or remove any part of the Site at any time without notice.

10. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot be excluded.

To the extent permitted by law, Proximity Plumbing is not liable for any loss or damage (including indirect or consequential loss, loss of data or loss of profit) arising from your use of, or inability to use, the Site or any content on it, or from reliance on any information on the Site. Where liability cannot be excluded but can be limited, our liability is limited to re-supplying the relevant service or paying the cost of having it re-supplied.

You indemnify Proximity against any loss, claim or expense arising from your breach of these terms or your unlawful use of the Site.

11. Privacy

Personal information you provide through the Site is handled in accordance with our Privacy Policy. Our use of cookies and tracking technologies is described in our Cookie Policy.

12. Changes to these terms

We may update these terms from time to time. The current version is always published at proximityplumbing.com.au/terms-of-use/ with its effective date. Your continued use of the Site after a change constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
